Your privacy is important to us. This policy explains what information we collect, how we use it, and what rights you have in relation to it. Please read it carefully.

1. Information We Collect

We collect information you provide directly to us, such as when you create an account, subscribe to a plan, or contact us for support. This includes your name, email address, payment information, and any content you upload or generate using Facecast. We also collect usage data automatically, including log data, device information, and information collected via cookies and similar tracking technologies.

2. How We Use Your Information

We use the information we collect to provide, maintain, and improve our services, process transactions, send you technical notices and support messages, respond to your comments and questions, and send you marketing communications (where permitted by law). We also use your data to monitor and analyze trends and usage, detect and prevent fraudulent transactions and other illegal activities, and personalize and improve the services.

3. Legal Bases for Processing

We process your personal data on the following legal bases: performance of a contract (to provide you with the services you've subscribed to), legitimate interests (to improve our services and prevent fraud), consent (for marketing communications), and compliance with legal obligations.

4. Data Sharing with Third Parties

We do not sell your personal information. We may share your information with third-party vendors and service providers that perform services on our behalf, such as payment processing, data analytics, email delivery, and customer service. We may also share information when required by law or to protect the rights and safety of Facecast, our users, and the public.

5. Cookies and Tracking Technologies

We use cookies, web beacons, and similar tracking technologies to track activity on our services and hold certain information. You can control the use of cookies through your browser settings and our Cookie Consent Manager. Note that disabling certain cookies may affect the functionality of our services.

6. AI-Powered Products

Facecast's face swap technology processes your video feed in real time. This processing occurs in our cloud infrastructure and is not stored unless you explicitly enable recording. The AI models used for face transformation are trained on consented datasets and do not retain identifiable information between sessions.

7. Social Login

If you choose to sign in using Google or Discord, we receive certain information from those services, including your email address and profile name. We do not receive your password for those services.

8. Data Retention

We retain your personal information for as long as your account is active or as needed to provide you services. You can request deletion of your account and associated data at any time by contacting hello@facecast.org. Recorded streams are retained for 30 days unless you download them.

9. Security

We use industry-standard security measures, including encryption in transit (TLS) and at rest (AES-256), to protect your information. However, no security system is impenetrable and we cannot guarantee the absolute security of our systems.

10. Children's Privacy

Facecast is not directed at children under the age of 13. We do not knowingly collect personal information from children under 13. If we learn we have collected such information, we will delete it promptly.

11. Your Privacy Rights

Depending on your location, you may have certain rights regarding your personal information, including the right to access, correct, or delete your data, the right to object to or restrict certain processing, and the right to data portability.

12. Do Not Track

We do not currently respond to Do Not Track signals. However, you can opt out of certain tracking through our Cookie Consent Manager.

13. US Resident Rights (CCPA)

California residents have specific rights regarding their personal information under the California Consumer Privacy Act, including the right to know what personal information is collected, the right to delete personal information, and the right to opt-out of the sale of personal information. We do not sell personal information.

14. Regional Privacy Rights

Users in Australia, New Zealand, and South Africa have additional rights under their respective local privacy laws. Please contact us at hello@facecast.org for region-specific requests.

15. Policy Updates

We may update this Privacy Policy from time to time. We will notify you of any changes by posting the new policy on this page and updating the 'Last updated' date. We encourage you to review this policy periodically.

17. Data Access and Deletion

To request access to or deletion of your personal data, email hello@facecast.org with the subject line 'Data Request'. We will respond within 30 days.

18. Session Replay and Data Masking

Facecast may use session replay technology to improve user experience. Sensitive fields such as passwords and payment information are automatically masked and never recorded.
